Excusable Homicide

Excusable homicide is another category of murder. In California there are two categories of excusable homicide.

The first category is a homicide “committed by accident and misfortune or in doing any other lawful act by lawful means, with usual and ordinary caution, and without any unlawful intent.” An example of this is where a person takes all the precautions and does everything right to go shooting and someone else wanders into the middle of the shooting range and ends up getting shot. So in other words, it is an accident.

The second category of excusable homicide is extremely similar to justifiable homicide that someone may not be able to spot the difference. How it can be distinguished from justifiable homicide is that excusable homicide involves some fault on the part of the person who uses deadly force. An example of an excusable homicide is if a person provokes a fight and then withdraws from it and then in an act of self-defense kills the other person. The homicide can then be classified as an excusable homicide as opposed to a justifiable homicide.

The distinction between justifiable and excusable homicide has disappeared and the term justifiable homicide is the term most widely used.
