Government fraud is a white collar crime and by definition are the intentional illegal acts that deprive the government of money by the use of scams and/or deception. When someone swindles the government, then it is the taxpayers who end up paying the price in the end. Government fraud is an extremely serious crime, and will be pursued and prosecuted to the fullest extent the law allows. Both civil and criminal charges can be brought against anyone who has committed government fraud. Types of Government FraudThere are many different types of government fraud, such as false claims, procurement fraud, and Medicare/Medicaid fraud. Procurement fraud is one of the most costly types of government fraud. An example of this type of fraud is a company who chooses to use bribes in order to win a contract despite the fact it was not the lowest bid or the best bid. Another example of procurement fraud is to bill the government for work that has not been completed or inflate the cost of labor and supplies. Contractors who are charged with procurement fraud under the Federal False Claims Act can have both criminal and civil charges brought against them. It is illegal to bring forth a false claim in order to defraud the government according to the Federal False Claims Act. These false claims can pertain to Social Security, healthcare fraud, or defense contracts where someone tries to profit from the government for an invalid reason. The potential penalties for government fraud are very severe. The person who is convicted of the crime must pay back three times the amount they stole in addition to a civil fine of $5000 to $10000. Many of the biggest government fraud lawsuits have been about government healthcare fraud. Medicaid/Medicare fraud happen when healthcare companies overestimate the costs of medical care or when physicians ask for reimbursement for lab tests or procedures that were never performed. Whistleblowers are generally the people who end up reporting Medicare/Medicaid fraud. Due to the False Claims Act, whistleblowers are rewarded by being allowed to receive a share of the award for cases for which they exposed the government fraud. These laws also provide protection for employees who are brave enough to report their employers for government fraud. Most of the whistleblower cases are localized in the areas of government healthcare or defense fraud, but whistleblowers can shed light on any type of government fraud. |
