DUI Laws : An Overview

Every state has a different set of DUI laws, but regardless of which laws are set in place, driving under the influence is illegal past a certain blood alcohol level.  DUI laws are set in place because they are designed to protect not only the driver of the vehicle, but their passengers, and the other cars on the road.  Alcohol and other intoxicants can have unexpected effects on a person who is trying to operate heavy machinery, and there is a positive correlation between the level of alcohol a person has ingested and the effect it has on their ability to drive.

 DUI Laws and Blood Alcohol Content

DUI laws consist of far more than blood alcohol level restrictions, but that is one of the most common guidelines that are followed when referring to DUI laws.  All fifty states declare that it is illegal to drive with a blood alcohol level over 0.08, and anyone driving with a BAC (blood alcohol content) over that amount is at risk for being arrested and charged with a DUI citation.  The reason this level is set as opposed to a drink maximum is because people process alcohol differently, and one drink may affect one person to the point of not being able to drive safely, whereas it may take several drinks for someone whose body weight is higher or who drinks more frequently.

 Differences in DUI Laws

Most of the differences in DUI laws come in the way that the driver is handled after being charged with a DUI citation.  Some states require immediate revocation of the driver’s license until their court appearance, others will allow the driver to keep their license if their car has been equipped with an ignition interlock.  An ignition interlock requires the driver to breathe into a tube that is directly connected to the engine, and if the driver has been drinking, the car will shut off automatically.  In some states, repeat offenders are forced to give up their vehicles until the charges have been lifted or the sentence has been fulfilled.  Other states enforce the open container law, which states that either the passenger or driver, or neither may have an open container of alcohol while the vehicle is in motion.  It is recommended that one never drive while under the influence of alcohol, but if that is the choice that a person makes they should familiarize themselves with their state’s DUI laws so they can follow the rules accordingly and avoid a DUI citation.
