In most states, conviction of a DUI offense carries stiff penalties. The DUI penalty you receive is due to the charge(s) you have been convicted of. In most instances a good DWI attorney will work to get the charges or your sentence reduced.

Below are DUI penalties for first offenses for residents of California.

  • 3 to 5 years of court probation - There is no probation officer to report to but this means you are not allowed to drink and drive during this time period.
  • Fines that include court costs and fees totaling $1400 to $1800 - These fees and fines can be paid over time if needed at an additional charge.
  • Loss of driver's license for 6 months - It is up to the Department of Motor Vehicle whether or not your driver's license should be restricted. If your license is suspended it means no driving. If it's restricted it means you can drive to and from school or work.
  • Mandatory driving school - The required hours will depend on what your blood alcohol level was. The hours may be as low as 12 or as high as 45. How good of attorney you have will also depend on how many hours you receive as well.
  • Jail time - For a first offense in California there is a 48 hour requirement. It is possible to have the required jail time converted to work service.

Hiring a good lawyer will make the difference between receiving the maximum DUI penalty or receiving a reduced penalty.
