A criminal defense lawyer is a legal professional who organizes cases and specializes in defending individuals and companies that are charged with committing a crime or participating in criminal conduct. Criminal defense attorneys also handle the personality of the crimes that his or her clients have been charged with. Criminal defense lawyers are allowed to presume that their clients are innocent in the United States until the prosecutors have proven the client guilty beyond a reasonable doubt. In the United States, serious crimes go to trial in front of twelve jurors. The jury has to be unanimous in its verdict to either convict the defendant or find them not guilty and acquit them. If the jury is split and can’t reach a verdict, then they are known as a “hung jury.” This could result in a retrial of the defendant. A good criminal defense lawyer will actively pursue their client’s case via every stage of a criminal prosecution.

 

There are many criminal defense attorneys in the United States who are employed by state and county governments. These are known as “Public Defenders.” In many cases, these Public Defenders are lawyers fresh out of law school and are looking to garner quick experience in the courtroom. However, many are older and very well experienced criminal defense lawyers who have decided to make public defending a lifetime job. You can also find private criminal defense lawyers who can be retained by clients on a case by case basis.

 

It can be very intimidating to some criminal defense lawyers to do criminal defense work as the pressure of keeping their client from going to jail for a long period of time or the possibility of capital punishment weighs on their shoulders. Due to this and many other factors, a criminal defense lawyer is truly a special breed of lawyer.

 

Everyone in America, citizen or not, is entitled to legal counsel before questioning can begin, no matter how serious the crime they are accused of committing. Anyone who is facing a criminal charge, no matter how big or small, will find it beneficial to consult with a criminal defense lawyer. Even if they do not retain the lawyer to provide them with representation in court, consulting them will help a criminal defendant understand the charges brought against them, what plea bargains will most likely be offered, their available defenses, and what will most likely happen if they are convicted of the crime they are being charged with.

 

It’s not always easy to find a competent criminal defense lawyer. You can find one via referrals, courtroom observation, professional organizations, or law directories. It is a defendant’s constitutional right to consult with a second criminal defense lawyer if they are not satisfied with their current lawyer’s performance. It may be that your lawyer is very competent, but if your lawyer is inept, then you will be the one to go to prison, not your attorney.
