One of the most frequent questions asked regarding misdemeanor charges is, "do I need a misdemeanor lawyer if I have been charged?" The answer is a resounding, yes. Even if you are innocent you still need a lawyer as your rights need to be protected.

Misdemeanors are more serious than infractions, and less serious than felonies. Misdemeanor convictions carry a punishment of less than one year in jail and fines of up to one thousand.

Misdemeanors are considered:

  • Trespassing
  • Probation violations
  • Domestic violence
  • Reckless driving
  • Driving without a license
  • Gambling
  • Driving while intoxicated - DUI/DWI
  • Disorderly conduct
  • Soliciting prostitutes
  • Violating restraining orders
  • Assault and battery that results in minimum or no injury

Misdemeanor charges can be elevated to felony charges if the prosecutor alleges a prior or similar act. This includes the possibility of increased jail time and a sentence in state prison. A few examples of these offenses are:

  • Domestic violence
  • Indecent exposure
  • Violation of a domestic violence order
  • Petty theft
  • Drunk driving with 3 priors on record occurring in a 10 year period
  • Loaded firearm in a public venue

It is never a good idea to fight any criminal charge on your own, misdemeanor or not. An experienced misdemeanor lawyer or felony attorney (if the charge is being elevated) is critical to a successful outcome. It isn't just the charge you are fighting, it's your future.
